Islam emphasizes on living your life in a prescribed manner and that includes planning to exit the world in the best possible way.

The importance of making an Islamic will is clear from the Holy Quran and Hadith.

It is prescribed that when death approaches any of you—if they leave something of value—a Will should be made in favour of parents and immediate family with fairness. ˹This is˺ an obligation on those who are mindful ˹of Allah˺.

[Surat al Baqarah 2:180]

Sayyiduna Abdullah Ibn Umar (RA) narrates that Rasulullah said:

“It is not befitting for a Muslim who has something to make a will of, to remain for two nights without having one’s last will and testament written and kept ready with one” (Bukhari-2587)

Islamic Will is a shariah compliant legally binding document. It instructs who inherits your assets and who will manage your estate and implement your wishes as per Islamic principles when you die. Unless a Muslim makes an Islamic Will, their wealth may not be distributed according to Quran and Sunnah in the Non-Muslim countries.

According to Australian government guidelines, a will is valid so long as it is prepared by someone who is over 18, of sound mind and witnessed by two people who will not inherit from the estate. The Australian law gives the flexibility to write a Will according to the Islamic values.

Yes. Every adult should have their own Will written. There is no rule that says only those with huge sums of money, properties, or other high-value assets must have a will, but rather it is recommended to have a will even if you have something of lesser value.

What can make a Will invalid?

  • The validity of a will may be questioned, for instance, if the testator has not signed the will or if their signature has not been witnessed by witnesses.
  • The testator lacked testamentary capacity to create a will. When a testator suffers from dementia or mental illness, they may not have the required mental ability to make the necessary decisions about their estate.
  • The testator was improperly influenced when drafting the will. Especially relevant is the situation of elderly and vulnerable testators who are pressured into making a will in their favour by others.
  • Fraudulently made or forgeried will. A will is a forgery when the testator’s signature was not witnessed, or the testator’s signature does not match legitimate examples, or the will contains errors the testator would not have made, or the beneficiary is not someone the testator would choose.
  • In addition, there may be other grounds to invalidate the will.
